ANJANA MISHRA ORAL ORDER 10-04-2018 Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Warisnagar P.S. Case No.234 of 2016 for allegedly having committed the offence under Sections 147, 148, 149, 341, 342, 323, 337, 338, 332, 333, 307, 353, 379, 393, 427, 504 of the Indian Penal Code and Section 5 of the Essential Service Maintenance Act.
Learned counsel for the petitioner submits that along with several other persons, the petitioner was also granted anticipatory bail by the learned Sessions Judge, but due to unforeseen reason, he could not surrender and file his bail papers in time. Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.16805 of 2018 (2) dt.10-04-2018 2/2 no sooner the order for anticipatory bail is passed, he will surrender before the court below and would file sureties to the satisfaction of the said court.
In view of the aforementioned submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, in connection with Warisnagar P.S. Case No.234 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
