The petitioner apprehends his arrest in Samastipur (Town) P.S. Case No. 189/2016, registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.
The informant alleged that petitioner took Rs. 1,68,000/- from different persons on the pretext of getting the students admitted in Navoday Vidyalaya.
Learned counsel for the petitioner submits that petitioner is a builder. He has not taken any money from the informant or any other person. He has falsely been implicated in the case. No chit of paper is filed to show that the petitioner received any money from the informant or any other person.
Patna High Court Cr.Misc. No.45785 of 2016 (3) dt.20-12-2016 2/2 Learned A.P.P. submits that parents of the students disclosed that Principal took money from them to get their children admitted in Navoday Vidyalaya.
Considering the facts aforesaid and the fact that petitioner is neither a teacher nor associated with the school and no chit of paper is filed to show that the petitioner received any money from the informant or any other person, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Samastipur (Town) P.S. Case No. 189/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
