This is an application for bail in connection with Bhagwanpur P.S.Case No. 202 of 2016 registered for the offences punishable under Section 393 of the Indian Penal Code. Allegation against the petitioner is that he intercepted the vehicle of the informant and assaulted the driver and father of the informant by butt of pistol and one miscreant has seated the driving seat of the informant's car.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case as it is a case of accident between two vehicles, one of the petitioner and another of informant and petitioner is in custody since 22.11.2016. Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.17680 of 2017 (2) dt.17-04-2017 2/2 for bail of the petitioner.
Having heard both sides and considering the allegation as well as criminal antecedents, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected. However, considering the fact that charge has been framed in this case, as submitted by learned counsel for the petitioner, learned trial court is directed to expedite the trial and try to conclude the same within a period of nine months. If the trial is not concluded within the said period, petitioner may renew his prayer for bail.
