The petitioner seeks anticipatory bail in connection with Bhagawanpur P. S. Case No. 68 of 2017, G.R. No. 1581 of 2017, registered for offenses punishable under Sections 3448/354 of the Indian Penal Code.

The allegation as per F.I.R. against the petitioner is that the petitioner misbehaved with the daughter of the informant and tried to outrage the modesty of the daughter of the informant and she is minor.

Submission of the learned counsel for the petitioner is that the allegation of kidnapping of the daughter of the informant is totally false and a case was lodged by the mother of the informant as Bhagwanpur P.S. Case No. 116 of 2017 against the petitioner and statement of the victim girl has been

Patna High Court Cr.Misc. No.20227 of 2018(2) dt.12-04-2018 2/3 recorded under Section 164 Cr. P. C. that she eloped with the petitioner with her own sweet will and neither the allegation of molestation has been alleged in the F.I.R. nor mentioned in the case diary.

Learned A.P.P. opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S.Case No. 68 of 2017, G.R. No. 1581 of 2017, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure.

With following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

ii) The petitioner will not induce any witness or tamper with the evidence.

iii)The petitioner shall co-operate in the investigation
