This application for grant of anticipatory bail arises out of Buddha Colony P.S. Case No. 170 of 2016, disclosing offence under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of Bihar Excise Act.

Considering the fact that the petitioner has criminal antecedent inasmuch as he is an accused in a case of similar nature, I am not inclined to grant him the privilege of anticipatory bail.

Accordingly, this application for anticipatory bail is, hereby, rejected.

The petitioner is directed to surrender before the

Patna High Court Cr.Misc. No.40534 of 2016 (2) dt.22-09-2016 2/2 court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
