The instance application has been renewed for bail which was earlier rejected by this court vide order dt. 21.4.2023 passed in Cr. Misc. No. 30944 of 2022 in connection with Sohsarai P.S. Case No. 23 of 2022 instituted for the offence u/s 302, 328, 120(B) of the Indian Penal Code and Sections 33, 34, 36 of the Bihar Prohibition and Excise Act.

It is submitted by learned counsel for the petitioner that the petitioner is languishing in judicial custody since 16.1.2022 and there is no hope to conclude the trial in near future.

In pursuance to the direction of this Court, a report dt.

Patna High Court CR. MISC. No.58969 of 2023(3) dt.13-10-2023 2/2 15.9.2023 with regard to the present stage of trial has been received by which it appears that the trial may be concluded within a period of three months after conclusion of prosecution evidence.

No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected.

However, learned trial court is directed to conclude the trial within period of six months, failing which, the petitioner will be at liberty to renew his prayer for bail. (Sunil Kumar Panwar, J) Sushma/- U T
