Petitioners seek regular bail in a case registered for the offence punishable under Section 406, 420, 379, 411, 120B/34 of the Indian Penal Code.

As per the prosecution case, these petitioners along with co-accused Didar Singh were apprehended with stolen truck trailor.

Learned counsel appearing for the petitioners submits that petitioners have been made accused in this case only on suspicion. It is further submitted that petitioner No.1 was going to his sister's house and on the road he was caught by the police

Patna High Court CR. MISC. No.64613 of 2021(2) dt.22-02-2022 2/2 on suspicion. Petitioner No.2 is driver of the truck and no case has been lodged by the owner of the truck or the merchant of Doda Beta which was loaded on the truck. Petitioners claim clean antecedent and are in custody since 14.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, West, Muzaffarpur in connection with Kanti PS case No.396/2021.
