Petitioner is an accused in a case registered for offence punishable under Sections 25(1-B)a/26(i)(ii)/35 of the Indian Penal Code.

Allegation in brief against the petitioner is that the apprehended another co-accused by the police from whose possession country made pistol was recovered along with two magazines, petitioner's name was disclosed as one of the accomplice.

Submission is that except the disclosure of the name of the petitioner by apprehended co-accused, there is no material against him and this petitioner is in custody since 29.08.2016 and the accused apprehended at the spot with arms was granted bail by

Patna High Court Cr.Misc. No.9318 of 2017 (2) dt.23-02-2017 2 / 2 a coordinate Bench of this Court vide Cr. Misc. No.37502 of 2016. Having considered the said facts and circumstances, let the petitioner, namely, Gopal Bind be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Munger, in connection with Naya Ram Nagar P.S. Case No.29 of 2016.
