JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2023 After some argument, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition so far as petitioner no. 1 Deepak Kumar Yadav is concerned.

2. Permission is accorded. The anticipatory bail petition stands dismissed as withdrawn so far as petitioner no. 1 is concerned.

3. Petitioner (Vishal Kumar) apprehends his arrest in a case registered for the offence under Sections 419, 420, 406, 506/34 of the Indian Penal Code.

4. It is submitted on behalf of petitioner that as per

Patna High Court CR. MISC. No.54982 of 2023(2) dt.28-08-2023 2/2 complaint petition itself, this petitioner is only alleged to be mediator. There is no allegation of misrepresentation or that he had prior knowledge of such representation being false. No money has been transferred in the account of this petitioner. He is not beneficiary of the alleged transaction. Dispute is of civil nature. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the petitioner namely Vishal Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Siwan in connection with Complaint Case No. 2215 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.

7. The anticipatory bail application is, accordingly, disposed of.
