The petitioner, who is in custody, seeks bail in connection with Manpur P.S.Case No. 02 of 2017 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation in brief is that 50 litres of illicit Nepali liquor, kept in a sack, were recovered from the possession of this petitioner.

Submission is that no such recovery was made from the possession of the petitioner, moreover, copy of the seizure list was not given to the petitioner and he is in custody since 09.01.2017 having no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely Sriram Diswa, is directed to

Patna High Court Cr.Misc. No.9248 of 2017 (2) dt.23-02-2017 2/2 be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Bettiah, West Champaran in connection with Manpur P.S. Case No. 2 of 2017.
