JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-03-2017 Heard learned counsel for the petitionerand learned counsel representing the State.

The petitioner seeks bail in connection with Awatar Nagar P.S. Case No. 173 of 2016 registered for the offence punishable under Sections 188/272/273 of the Indian Penal Code and Section 47 of the Bihar Excise Act, 2016. Allegedly, 10 liters of country made mahua liquor and 1/2 kg Nausadar were recovered from the house of the petitioner and for that the petitioner is in custody since 06.12.2016 having no criminal antecedent.

In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail

Patna High Court Cr.Misc. No.5215 of 2017 (2) dt.10-03-2017 2/2 bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri M.P. Yadav, J.M. (Court No.12) Saran at Chapra, in connection with Awatar Nagar P.S. No. 173 of 2016, , subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
