Mr. SRI S.M. RAHMAN ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Kotwali P. S. Case No. 450 of 2017 registered for the offences punishable under Sections 417, 418, 419, 420 and 120B of the Indian Penal Code.

From the written report it reveals that Suman Singh called the informant through his mobile to deposit Rs. 20,000/- in the account of the Examination Board for passing the TET Skill Test 2017. The name of this petitioners have come during investigation on the basis of confessional statement of coaccused Nitish Kumar. In the written report it is mentioned that

Patna High Court Cr.Misc. No.11370 of 2018(2) dt.27-02-2018 2/3 Suman Singh made demand of money and also gave the account number for depositing the aforesaid amount.

Submission is of false implication and that besides the confessional statement of co-accused there is no other legal and tangible material against the petitioners. In this case, similarly situated co-accused Mukesh Kumar Gupta @ Muffa Aafat has been allowed pre-arrest bail vide Cr. Misc. No. 57020 of 2017, Ravi Kumar and another have been allowed pre-arrest bail vide Cr. Misc. No. 55487 of 2017, Dashrath Kumar has been allowed pre-arrest bail vide Cr. Misc. No. 60928 of 2017, Ajay Kumar has been allowed pre-arrest bail vide Cr. Misc. No. 57683 of 2017 and Kaushal Kumar Pandey. has been allowed pre-arrest bail vide Cr. Misc. No. 62677 of 2017 and as such the petitioners also deserve sympathetic consideration. Learned APP fairly submits that similarly situated other co-accused have been allowed pre-arrest bail.

In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs.
