====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in N.D.P.S. Case No. 14/2016, arising out of Mohania P.S. Case No. 284 of 2016 instituted for the offence under Sections 17, 22, 25, 27, 27(A) of Narcotic Drugs and Psychotropic Substances Act. It is alleged in the written report that 26 grams of Heroin was recovered from the possession of Mohan Mallah and 60 grams of Heroin was also recovered from his house. Mohan Mallah was arrested by the police and he has disclosed the name of the petitioner.
Case Diary has been received.
Learned A.P.P. has submitted that from perusal of the case diary, appears that no recovery of any narcotic substance
Patna High Court Cr.Misc. No.4373 of 2017 (3) dt.17-03-2017 2/2 has been made from the possession of this petitioner. Petitioner has been named by co-accused who has been arrested by the police and aforesaid Heroin has been recovered from his possession.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Kaimur at Bhabhua, in connection with N.D.P.S. Case No. 14/2016, arising out of Mohania P.S. Case No. 284 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) Ravi/- U T
