For the Opposite Party/s : Mr. Atul Chandra, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 25-06-2015 This application under Section 438 CrPC is filed with a prayer to grant anticipatory bail to the petitioner who is an accused in connection with Sikta PS Case No. 50 of 2012 registered under Sections 419, 420, 467, 468, 471, and 120(B) of the Indian Penal Code.

The petitioner, apprehending his arrest, filed ABP No. 860 of 2012 before the court of learned Sessions Judge, West Champaran, Bettiah and the same was rejected through order dated 29.11.2012.

Earlier this Court directed that pending further orders no coercive steps shall be taken against the petitioner. Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor.

Patna High Court Cr.Misc. No.7533 of 2013 (5) dt.25-06-2015 2/2 The allegation against the petitioner is one of cheating. It may be true that the complainant is a close relation of the petitioner. Though not as a serious preventive measure, at least to have hold on the petitioner in the course of prosecution, it is essential that he appears before the court. The petitioner can move a bail application on the same day.

Hence, this application is disposed of leaving it open to the petitioner to appear before the trial court within four weeks from today and, if an application is filed for grant of bail, the same shall be taken up and disposed of on that day itself or maximum by the next day.
