The petitioner seeks bail in a case registered for the offences punishable under Section 304(B)/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 04.08.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that Rahul Kumar used to abuse his daughter (deceased), who once left Rahul's house and on intervention of the police, a bond was signed by Rahul Kumar that he will keep the victim with dignity failing which, fine of Rs.50,000/-, It is further alleged that on 02.08.2021, Rahul Kumar informed that the deceased had committed suicide. Thus,

The learned counsel for the petitioner submits that the informant is not an eye witness to the occurrence. The allegation hinges around suspicion. The petitioner is mother-in-law, who is separate in mess and property from her son and husband (Rahul Kumar) is in custody since 04.08.2021.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and the husband of the deceased is in custody, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nawada Town P. S. Case No.815 of 2021.

The application stands allowed.
