This is an application for bail in connection with Sono (Charkapathar) P.S.Case No. 146 of 2016 registered for the offences punishable under Sections 147, 148, 149, 307, 302, 121A, 452, 504 of the Indian Penal Code, 27 of the Arms Act and 16,17,18,19,20,21,22 of U.A.P. Act.

Petitioner is named in the FIR but he is not assailant, rather he is order-giver.

It has been submitted on behalf of the petitioner that petitioner is not the assailant and he is in custody since 26.9.2016. Heard learned APP also.

Having heard both sides and from perusal of the

Patna High Court Cr.Misc. No.13022 of 2017 (4) dt.20-04-2017 2/2 record it appears that there is allegation that he is order-giver and he is also accused in two more cases. However, it appears that petitioner has not mentioned about second case in paragraph-3 of the petition and suppressed the same, which is evident from the report submitted with regard to criminal ante4cedents of the petitioner. Considering the aforesaid aspect of the matter, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected. However, learned trial court is directed to expedite the trial.
