This is a petition for grant of regular bail for offences under Sections 30(A) and 38 of the Bihar Excise Act.
From the referred four wheeler, 440 liters of liquor was recovered. The petitioners were apprehended at the spot.
Submission of the petitioners is that the liquor does not belong to them and they were merely passengers. They are in custody since 29.12.2016.
Considering the facts and circumstances of this case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-
Patna High Court Cr.Misc. No.9554 of 2017 (2) dt.11-04-2017 2/2 (rupees ten thousand) each with two sureties of the like amount each in connection with Nabinagar P.S. Case No. 229 of 2016 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or successor Court on completion of four months in custody.
