This is an application for grant of anticipatory bail in connection with Tatarpur (University) P.S. Case No. 287 of 2017 registered for the offence punishable under Sections 147, 149, 323, 324, 307, 354(B), 504 and 506 of the Indian Penal Code.

The allegation in the present case is regarding the petitioners assaulting the informant and his family members after entering into the house of the informant and thereafter running away with the jewellery, cash etc.

The learned counsel for the petitioners submits that the prosecution side and the informant side are agnates and the FIR

Patna High Court Cr.Misc. No.10587 of 2018(2) dt.22-02-2018 2/2 has been lodged two days belatedly. It is further submitted that the allegation whatsoever is general and omnibus in nature and there is no allegation of any specific overt act as far as the petitioners are concerned. The petitioners are stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioners herein to the privilege of anticipatory bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Bhagalpur in connection with Tatarpur (University) P.S. Case No. 287 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
