JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sakatpur P.S. Case No. 37 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323, 324 and 307 of the I.P.C.

The allegation against the petitioner is that in the occurrence he assaulted Gauranand Jha with farsa on his head which was stopped by hand resulting cut injury in the finger. Submission is of false implication and that no injury caused by sharp cutting weapon was found on the person of Gauranand Jha, all the injuries were caused by hard and blunt substance and injury no. l which is lacerated wound on the left

Patna High Court Cr.Misc. No.6964 of 2017 (3) dt.18-03-2017 2/2 little finger has been noticed as simple in nature, in this case other co-accused have already been allowed pre-arrest bail vide Cr. Misc. No. 46752 of 2016 and further vide Cr. Misc. No. 4133 of 2017, the petitioner having clean antecedent also deserves sympathetic consideration.

The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail by another co-ordinate Bench of this Court.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Darbhanga in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
