The present application has been filed under Section 482 of the Code of Criminal Procedure, 1973 seeking quashing of the entire proceeding of G.R. No. 3889 of 2012/ Tr. No. 3198 of 2013 including the order dated 14.03.2013 passed by the Judicial Magistrate, 1st Class, Ara by which cognizance has been taken under Section 171 G of the Indian Penal Code and Section 125(3) of The Bihar Panchayat Raj Act, 2006 as well as Section 125 (A) of The Representation of People Act, 1951.

Learned counsel for the petitioner submits that he had not made any misrepresentation in the affidavit filed at the time of contesting election and erroneously cognizance has been taken.

However, after some arguments learned

Patna High Court Cr.Misc. No.18577 of 2013 (4) dt.02-07-2015 2/2 counsel for the petitioner seeks permission to withdraw the application with liberty to raise all the points available to him, including those taken in the present application, at the time of framing of charge before the Court concerned.
