1. Though the present writ petition has been filed for quashing of the order dated 24.03.2017, passed by the Civil Surgeon-cum-Chief Medical Officer, Gaya, whereby and whereunder although the suspension of the petitioner has been revoked but it has been stipulated therein that payment of the balance amount of salary, other than the subsistence allowance, for the period of suspension shall be dependent on the final outcome of the criminal case, nonetheless, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file

Patna High Court CWJC No.14978 of 2023(2) dt.15-04-2024 2/2 appropriate appeal against the aforesaid order dated 24.03.2017. Liberty so sought is granted.

2. It is needless to state that as far as grant of the benefits of ACP/MACP scheme are concerned, the petitioner would be at liberty to approach the respondent no.2 i.e. the Director-in-Chief Health Services, Government of Bihar, Patna, by filing appropriate representation within a period of two weeks from today, which shall be decided by the respondent no.2, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

3. The writ petition stands disposed off on the aforesaid terms.
