Petitioner is in custody since 15.06.2016 in connection with S.Tr. No. 74 of 2017 arising out of Bhagwanbazar P.S. Case No. 166 of 2016 registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case and there is no direct allegation either of firing or any assault against the petitioner. Charges have already been framed and there is no allegation of tampering with the evidences against the petitioner. The petitioner is rotting in custody for the last eight months.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.12478 of 2017 (2) dt.24-03-2017 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-10th, Saran at Chapra in connection with S.Tr. No. 74 of 2017 arising out of Bhagwan Bazar P.S. Case No. 166 of 2016.
