JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-11-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code as well as under Sections 30(a)/36/41(i) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got four criminal antecedents of similar nature as stated in paragraph-3 of the bail application. It is further submitted that petitioner is not named in the FIR. During investigation, it has come that the petitioner is the Director of Sri Om Bottlers and

Ltd. situated in the township of Bokaro and only on the basis of rappers, which belong to the petitioner's company, the petitioner is made accused in the present case. It is submitted that one of the members/Directors of the said company is already in judicial custody.

Taking into consideration the facts and circumstance of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Malaypur P.S. Case No.58 of 2021, pending in the court of learned Special Judge, Excise-1, Jamui.
