The petitioner is apprehending arrest in a case registered for the offences punishable under sections 419 and 420/34 of the IPC.

The accusation against the petitioner is that at Intermediate Examination one Sanjeet Kumar was appearing in place of the petitioner, who was apprehended from the examination hall. It is submitted by learned counsel for the petitioner that the petitioner was not aware about Sanjeet Kumar appearing at the examination in his place and even assuming the accusation, at best, a case under section 419 of the IPC is made out, which is bailable. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. It is further submitted that non-grant of bail will jeopardize the

Considering the fact that thrust of accusation is against Sanjeet Kumar and the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Pandaul P.S. Case No. 22 of 2017 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
