The petitioners apprehend their arrest in Pranpur (Roshana OP) P.S. Case No. 51 of 2021, registered for the offences punishable under Sections 302, 498A and other allied sections of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
Prosecution case in brief is that the accused persons including these petitioners subjected the sister of informant (deceased) to torture and cruelty for dowry. It is further alleged that all the accused persons persons killed the sister of informant along with her two minor children by setting them on fire.
Patna High Court CR. MISC. No.64509 of 2021(2) dt.23-05-2022 2/2 It is submitted that petitioners have been falsely implicated in this case. There is general and omnibus allegation. Petitioner no. 1 is brother-in-law and petitioner 2 is sister-in-law of the deceased and they are separate in mess and property. They have got no concern with the family affairs of the deceased and her husband. Husband of the deceased is already in custody. Petitioners have got clean antecedent. Counsel for the informant opposed the prayer for bail. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Katihar in connection with Pranpur (Roshana OP) P.S. Case No. 51 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
