The petitioner was posted as Panchayat Secretary of Gram Panchayat, Govind Chak under the district of Chapra. Appointments were made to the post of Siksha Mitra in the said Gram Panchayat. In course of enquiry, it was detected that the records relating to appointment of Block Teacher, Anup Kumar Rai, were missing. Upon an enquiry, it was found that the documents had been stolen away purposively.

Upon perusal of the First Information Report, I am of the view that no case of quashing of the First Information Report is made out as the allegations make out offence under various provisions of the Indian Penal Code, which are cognizable in nature. This application is, accordingly, dismissed with a liberty to the petitioner to raise all such plea in the present application at the stage of framing of charge.
