2. The petitioners seek regular bail in connection with Chewara P.S. Case No. 43 of 2025 for the offences registered under Sections 238, 318(4), 3(5) of the B.N.S. and Sections 30(a), 32, 41(1) of the Bihar Prohibition & Excise Act.

3. There is recovery of 3852.6452 litre foreign liquor from the Tank lorry which was driven by petitioner no. 1. Petitioner no. 2 was co-driver.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. He submits that allegation against the petitioners is that

Patna High Court CR. MISC. No.52630 of 2025(3) dt.24-09-2025 2/2 they had assigned to deliver the said Tank lorry to Mithapur, Patna. They have no concern with the seized liquor. Petitioners have no criminal antecedent. They are in custody since 22.06.2025. Petitioners undertake to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioners.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioners, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Excise Court, Sheikhpura in connection with Chewara P.S. Case No. 43 of 2025.
