JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 30-03-2016 By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks a direction to be issued to the respondent no.2 the Director General of Police-cum-Inspector General of Police, Bihar, Patna to transfer investigation of Chautham P.S. Case No.107 of 2015 registered under section 302 read with 34 of the Indian Penal Code and section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 to the Crime Investigation Department or any other investigating agency because the petitioner has no faith in the

Patna High Court Cr. WJC No.1275 of 2015 dt.30-03-2016 2/2 police officer posted at Chautham Police Station.

2. Admittedly, the petitioner is neither informant nor an accused in Chautham P.S. Case No.107 of 2015. The said case was instituted on the basis of a written report submitted by one Hanshraj Shekhar son of the deceased Ramanand Paswan. The aforesaid Ramanand Paswan has not been made party to the present case in any capacity.

3. In that view of the matter, this court is of the opinion that the petitioner has got no locus standi in the matter. Accordingly, the application is dismissed.
