The petitioners apprehend their arrest in Naubatpur P.S. Case No.352 of 2017 registered under Sections 307, 341, 323, 504, 447 and 34 of the Indian Penal Code.

The informant, Hareshwar Rai alleged that while he was irrigating his field his step brother, Ram Raj Rai and his son assaulted him. The informant got injury on his head. The learned counsel for the petitioners submits that the petitioners are the step brother and son of step brother of the informant. On account of land dispute, the occurrence took place. The injury report shows that the informant got simple injury. On account of land dispute some scuffle took place.

Patna High Court Cr.Misc. No.11629 of 2018 (2) dt.27-02-2018 It appears that petitioners are nonetheless but the step brother and son of step brother. Petitioner No.2 is son of petitioner No.1. Some dispute arose between the informant and the petitioner on account of land dispute in which the informant received injuries which are simple in nature.

Taking into consideration the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur, District-Patna in connection with Naubatpur P.S. Case No.352 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
