2. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 118(1), 118(2), 303(2) and 109 of the B.N.S.
3. Learned counsel appearing on behalf of the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 14.07.2024 at about 05:00 p.m., all accused persons including petitioners came in the courtyard of the informant and thereafter assaulted the father and brother of the informant who became unconscious. It is further submitted that petitioners have falsely been implicated in the
Patna High Court CR. MISC. No.54796 of 2025(2) dt.03-09-2025 2/2 instant case by the informant. It is next submitted that no specific allegation of assault is alleged against the petitioners. It is further submitted that brother-in-law of the petitioners is agnate of the informant. It is also submitted that the parties have compromised the case as would manifest from Annexure-3 to the anticipatory bail application.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by learned counsel for the petitioner and taking into consideration the fact that petitioners are persons with clean antecedent, let petitioners, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Mirganj P.S. Case No. 83 of 2024, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.
