JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Araria (R.S.) P.S. Case No. 271 of 2016 instituted for the offence under Sections 461 and 379 of the Indian Penal Code.
As per allegation some unknown miscreants after breaking the lock of factory of the informant entered in the factory premises and tied the legs and arms of Night Guard, took away cash Rs.1,00,000/-. The First Information Report has been lodged against unknown.
It has been submitted on behalf of the petitioner that it has come in paragraph 49 of the case diary that recovered SIM is in the name of the petitioner.

Patna High Court Cr.Misc. No.4556 of 2017 (3) dt.28-03-2017 2/2 Learned A.P.P. has submitted that the name of the petitioner has come during investigation in the confessional statement of co-accused Ranjeet Kumar Das and, thereafter, one SIM has been recovered from possession of the petitioner which is said to belong to the Night Guard.
It is admitted position that the petitioner has not been put on Test Identification Parade. The petitioner is in custody since 10.8.2016 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria (R.S.) P.S. Case No. 271 of 2016, G.R. No. 1282 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
