JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code, Sections 47(a)/57 of the Bihar Excise (Amendment) Act, 2016 and Section 30(a)/38(i)(ii)/47(i) of the Bihar Prohibition and Excise Act, 2016.
A truck loaded with liquor was intercepted near the hotel whereof the petitioner was owner. The cleaner and driver of the truck fled away. Suspicion is that the petitioner was aware of the transaction of transportation of liquor rather he was involved.
Considering the aforesaid materials, let
Patna High Court Cr.Misc. No.13330 of 2017 (2) dt.22-03-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dalsinghsarai, Samastipur/Successor Court, in connection with Ujiyarpur P.S. Case No.200 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
