NATH ORAL ORDER 17-09-2016 Heard learned Counsel for the petitioner and the learned Counsel appearing for the respondent No. 2, the Bank. The grievance of the petitioner is that in spite of the instruction and direction by respondent No. 1, the respondent Bank has not paid the revised pension amount to the petitioner up till date. Learned Counsel for the petitioner has relied upon the letter dated 9.12.2014 issued by respondent No. 1, whereby the petitioner has been informed that instruction with regard to payment of revised pension amount was already issued to the respondent Bank as far back as on 6.9.2011.

Learned Counsel appearing for respondent No. 2 Bank, has been fair in his submission that if the instruction is there regarding payment of revised pension amount to the petitioner, there cannot be any legal impediment for not paying the same to the petitioner.

Patna High Court CWJC No.8885 of 2016 (2) dt.17-09-2016 After considering the aforesaid submission and the materials on record, this writ application is disposed of with a direction to the petitioner to approach respondent No. 2, the Bank, with appropriate petition along with a copy of the letter dated 9.12.2014 (Annexure 3) requesting them to make payment accordingly. If the petition is filed by the petitioner, the respondent No. 2 Bank is hereby enjoined to make payment to the petitioner in accordance with the instruction received by them from respondent No. 1 by letter dated 6.9.2011 or pass appropriate speaking order in that regard within a maximum period of four week from the date of receipt of the petition.
