JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-02-2018 The petitioners seek bail in anticipation of their arrest in connection with Pranpur (Roshna) P.S. Case No. 160 of 2017 dated 23.09.2017 instituted for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

One Sanjeev Yadav was apprehended with around 27 litres of liquor. This arrest was made on chase by the police party. Some of the miscreants are said to have run away. The aforesaid Sanjeev Yadav is said to have named the petitioners as his associates.

Learned counsel for the petitioners has submitted that the only material, therefore against them is that they have been named by the co-accused person who was arrested on

Patna High Court Cr.Misc. No.4771 of 2018 (2) dt.05-02-2018 2/2 the spot and from whose possession around 27 litres of liquor was recovered.

The petitioners do not bear any criminal antecedents.

For the facts aforesaid, the petitioners, above named are directed to be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to their furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Katihar in connection with Pranpur (Roshna) P.S. Case No. 160 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
