The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the accused persons abused the informant his wife by calling caste name for tying the cow on road and snatched jewellery and mobile. It is submitted by learned counsel for the petitioners that for the occurrence of 01.09.2015 the FIR was

Patna High Court Cr.Misc. No.56172 of 2015 (2) dt.10-12-2015 2/2 registered on 10.09.2015 and for a petty dispute the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The place of occurrence is the door of the informant which cannot be treated to be place of public view.

Considering the delayed lodging of the case and the accusation in the background of petty dispute, let the above named petitioners be released on anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria SC/ST P.S. Case No. 51 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
