Petitioner apprehends his arrest in connection with Ekma P.S. case no. 9 of 2016 instituted for the offence under Section(s) 409 and 420 of the Indian Penal Code. The allegation against the petitioner is that he received an amount of Rs. 7,22,000/-(Seven lacs twenty two thousand) during the financial year 2008-2009 for construction of school buildings as mentioned in the written report but the construction work is not complete. Learned counsel for the petitioner has submitted that he has already finished the construction work. It is mentioned in the impugned order that a report was called for from the D.P.O. and it was mentioned in the report that petitioner has not completed the construction work of the

Patna High Court Cr.Misc. No.12165 of 2018(3) dt.06-04-2018 2/2 building for which the amount was paid and several works of the building was incomplete as per the report of the District Programme Officer, Saran. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected. In the event petitioner surrenders before the Court below and submit a report about completion of entire work within a period of six weeks from today and make prayer for regular bail in that event the Court below will pass appropriate order in accordance with law after taking into consideration that the work has been completed.
