2. The petitioner apprehends arrest in connection with Amnaur P.S. Case No. 206 of 2021 dated 12.08.2021, instituted for the offence punishable under Sections 341, 323, 324, 354(B), 379, 447, 504, 506/34 of the Indian Penal Code.

3. The prosecution case, in short, is that on 12.08.2021, the informant was going to take bath. Her husband had gone in the village. Taking the advantage of loneliness, the petitioner entered into the house of the informant and started obscene activities. When the informant started shouting, then her husband and devar reached there and the petitioner fled away. Other accused persons who were armed with weapon entered into her house and started abusing and assaulting. It is

Patna High Court CR. MISC. No.57511 of 2024(2) dt.04-09-2024 2/3 further alleged that accused persons snatched away gold ornaments worth Rs. 2,50,000/- and cash Rs. 20,000/-. It is further alleged that the accused persons threatened to kill the informant and his son.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that informant is the wife of cousin of the petitioner. It is next submitted that there is case and counter case between the parties. The counter case vide Amnaur P.S. Case No. 196 of 2021 was lodged on 02.08.2021 by wife of the petitioner under Sections 341, 323, 354(B), 447/34 of the I.P.C. against informant and others. It is next stated that wife of the petitioner has also lodged Amnaur P.S. 263 of 2021 under Sections 341, 323, 354(B), 447/34 of the I.P.C. against informant and others. In the said FIR, the family members of the petitioner had been brutely assaulted by the accused persons. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in

Case No. 206 of 2021, he/they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, subject to condition as laid down under Section 438(2) of the Cr.P.C.
