JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 413/414/34 of the Indian Penal Code.

The petitioner is in custody since 14.09.2016 with allegation that the stolen motorcycle was recovered from the house of the petitioner, which is in occupation of several persons, and charge sheet has already been submitted in this case. Hence, there is no need for further detention of the petitioner in this case. Accordingly, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the

No.16312 of 2017 (2) dt.04-04-2017 2/2 satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran/Successor Court, in connection with Ghorasahan P.S. Case No.363 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
