JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 21-07-2015 The petitioner submits that Flat No.7H.F. 2/29, Bahadurpur Housing Colony, Patna was allotted to him and on demand he deposited a sum of Rs.83, 418.00 on 31.12.1999 within time. Thereafter, the Board vide its letter dated 5.1.2005 again demanded a sum of Rs.1,94,333/-, which demand, according to the petitioner, was illegal. However, the petitioner deposited the aforesaid amount. The petitioner prays for refund of the excess amount.

Despite time granted by this Court vide order dated 10.5.2013, no counter affidavit has been filed on behalf of the Board.

In the circumstances, this writ application is disposed of with an observation that if the petitioner files a fresh representation raising his grievance with respect to refund of excess amount

Patna High Court CWJC No.6372 of 2013 (3) dt.21-07-2015 deposited by him before the Managing Director, Bihar State Housing Board, Patna, the same would be disposed of within four months from the date of its filing.

It is made clear that this Court has not expressed any opinion on the merit of the case whether any excess amount has been paid or not.
