1. Heard Mrs. Rina Sinha, learned counsel for the petitioner and Mr. Amitesh Kumar, learned APP for the State.
2. The petitioner seeks regular bail in connection with Beur P. S. Case No. 264 of 2025 dated 26.05.2025 registered for the offence punishable under Sections 111(2) and 61(2) of the B.N.S and Sections 25(1-B)(a), 26 and 35 of the Arms Act and Sections 8 and 20(b)(ii) (A) of the N.D.P.S. Act.

The main submissions advanced by the petitioner's counsel are that the petitioner is a lady and has been languishing in jail since 27.05.2025, though, the instant matter relates to the recovery of eight country-made pistols, nineteen magazines, Rs. 51,550/- in cash and 800 grms Ganja from a room in the petitioner's house but the said room had in fact been rented out by the petitioner to one Sagar Kumar which is clearly apparent from

No.53809 of 2025(2) dt.18-08-2025 2/3 the FIR itself and further as per the prosecution story, when the police raided the said room nine accused persons including seven males and two females including the petitioner were found therein but the allegation regarding the presence of this petitioner at the alleged place is completely false, in fact, she was residing on the first floor of her residential building whereas the rented rooms including the place of recovery are situated on the ground floor and second floor. It is further submitted that the petitioner's past history is completely clean, she has never remained involved in such type of alleged occurrence previously and she has been made an accused mainly on the ground of being the owner of the alleged room.
It is lastly submitted that one co-accused Aryan Kumar, who was allegedly apprehended along with the other co-accused persons, has already been granted bail by the co-ordinate bench of this court vide order dated 11.08.2025 passed in Cr. Misc. No. 51582 of 2025 and the case of this petitioner stands on a better footing than this.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the facts that the petitioner is a lady and she had rented out one of the rooms of her building to coaccused Sagar Kumar and the accused persons with firearms were

No.53809 of 2025(2) dt.18-08-2025 3/3 apprehended from the rented room and also coupled with petitioner's clean past history and her custody period as well as the privilege of bail already granted to the co-accused Aryan Kumar by the co-ordinate bench of this court and the petitioner's case stands on a better footing than the said co-accused, in my opinion, in the aforesaid circumstances, the petitioner deserves to the relief of bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Beur P. S. Case No. 264 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
