Petitioner apprehends his arrest in Excise P.S. Case No.60 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The excise officials raided the house of the petitioner and from the premises of the house of the petitioner situated behind the house of the petitioner recovered 7.56 litres Imperial Blue whisky kept in 42 bottles each containing 180 ml. Learned counsel for the petitioner submits that the boundary of the place from where recovery was made is described in para 6 of the prosecution report. Patna High Court CR. MISC. No.50253 of 2019(2) dt.13-08-2019 2/2 perusal of the prosecution report and column 7 of the report, it appears that the recovery was made from inside the premises of the house of the petitioner.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
