JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 399/402/353/307 of the Indian Penal Code and Sections 25(1-B)a/26/27/35 of the Arms Act. Six motorcycles said to be stolen property were recovered by the police and the criminals standing there fled away. One of the co-accused Manjesh Yadav was apprehended at the spot and from whose possession one country-made pistol with six pellets were recovered.
Submission is that name of the petitioner has transpired on the basis of confessional statement of co-accused Manjesh Yadav and he is in custody since 20.12.2016.
Patna High Court Cr.Misc. No.16291 of 2017 (3) dt.15-05-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Khagaria/Successor Court, in connection with Pasraha P.S. Case No.118 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
