2. The petitioner seeks bail in connection with Gopalganj Town P.S. Case No. 352 of 2024 registered for the offence under Section 341, 323, 324, 307 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is the assailant of the victim who has sustained some injuries.

4. Though, from the FIR, the case has been made out to be a very serious case but relying on the injury report, it has been argued by the learned counsel for the petitioner that the victim had sustained injuries in a road accident and the

Patna High Court CR. MISC. No.59362 of 2024(2) dt.28-08-2024 2/2 petitioner has falsely been implicated in this case. He further submits that the petitioner is in custody since 10.05.2024.

5. Learned counsel for the informant had assisted the learned APP for the State and has vehemently opposed this application. He has submitted that the victim has been brutally assaulted by the petitioner and he has sustained eight injuries and therefore the petitioner may not be released on bail.

6. Considering the injury report and the FIR, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj/concerned Court below in connection with Gopalganj Town P.S. Case No. 352 of 2024.
