Perused the impugned order dated 28.09.2015 passed by Sub Judge II, Bhagalpur in Title Suit No.227 of 1999.

It appears that earlier the trust respondent No.3 was being represented by the Chairman, Birendra Prasad Gupta. On his death, new Chairman was nominated, namely, Devendra Prasad Gupta who was substituted in place of Birendra Prasad. The plaintiff filed application for substituting the legal representatives of Birendra Prasad Gupta. Considering the fact that the newly nominated Chairman has already been substituted, the Court below by the impugned order has rejected the substitution application.

In such view of the matter, I find no reason to interfere with the impugned order. Accordingly, this writ application is dismissed. Sanjeev/- (Mungeshwar Sahoo, J) U T
