The petitioners, already in custody, seek bail in connection with Daraunda P.S. Case No. 194 of 2016 registered under Sections 413 and 414 of the Indian penal Code and Section 25(1-b), 26 and 35 of the Arms Act.

Allegation in brief is that the police, on information that the petitioners were engaged in purchase and sale of stolen motorcycle, raided the house of the petitioners and recovered a country made pistol loaded with one live cartridge and two live cartridges from the pocket of Rajiv Singh besides one mobile set and from the pocket of the petitioner no. 1 Lallan Singh, one revolver and two live cartridges besides one mobile set and a Laptop, and some parts of the motorcycle kept inside a plastic

Patna High Court Cr.Misc. No.15371 of 2017 (2) dt.29-03-2017 2/2 sack and a motorcycle were also recovered.

Submission is that in the seizurelist, witnesses are only raiding police personnel and not any independent witness and the motorcycle was purchased by the petitioner no. 2 and for transferring the vehicle, paper was already submitted in the Transport office and both petitioners have no any criminal antecedent and they are in custody since 03.12.2016. Having considered the aforesaid facts and circumstances, the petitioners, namely, Lallan Singh and Rajiv Singh are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Siwan in connection with Daraunda P.S. Case No. 194 of 2016.
