2. Learned counsel for the petitioner, at the very outset, prays for and is permitted to withdraw this application with regard to petitioner no. 1 so that he can surrender and pray for regular bail.

3. Accordingly, this application is dismissed as withdrawn with regard to petitioner no. 1 and the Court below is directed to consider the bail application of petitioner no. 01 without being prejudiced by the fact that he had preferred an application for grant of anticipatory bail and the same has now been withdrawn. The Court below will also consider the bail application of the petitioner in view of the order dated 21.08.2024 passed by this Court in Cr. Misc. No. 53858 of 2024. This application is restricted to petitioner no. 02 only.

4. The petitioner no. 02 apprehends his arrest in

Patna High Court CR. MISC. No.57450 of 2024(3) dt.11-12-2024 2/2 connection with Paharpur P.S. Case No. 184 of 2024 registered for the offence under Sections 341, 342, 323, 325, 324, 307, 379, 504/34 of the Indian Penal Code.

5. So far as petitioner no. 02 is concerned, it has been submitted by the learned counsel for the petitioner that there is no allegation of any assault against him and there is ornamental allegation of theft/snatching against petitioner no. 02.

6. Considering the facts and circumstances of the case, this application for grant of anticipatory bail of the petitioner no. 02 is allowed.

7. Accordingly, let the petitioner no. 02, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned AJCM-XI, Motihari, East Champaran/concerned Court below in connection with Paharpur P.S. Case No. 184 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sandeep Kumar, J) Vikas/- U
