JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that prosecution has already closed its evidence and the statement u/S 313 of the Cr.P.C. has also been recorded. Now, the case is pending for recording defence evidence.

In the aforesaid circumstance, I do not think it proper to release the petitioner on bail and accordingly, his prayer for bail in connection with Sitamarhi P.S. Case No. 28 of 2010 corresponding to Sessions Trial No. 463 of 2012 pending in the court of learned Ad hoc Additional District & Sessions Judge-Ist, Sitamarhi stands rejected.

However, the concerned court is directed to dispose off

Patna High Court Cr.Misc. No.14293 of 2015 (8) dt.10-12-2015 2/2 the aforesaid case within a month from the date of receipt/production of copy of this order.
