This is an application for bail in connection with Special Case No. 43 of 2016, arising out of Araria (R.S.) P.S.Case No. 835 of 2016 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and 22(B) of NDPS Act and Sections 30 and 38 of the Bihar Excise Act. It has been submitted on behalf of the petitioner that petitioner is driver and there is recovery of 160 bottles of cough syrup of 100 ml. each containing codeine from the Auto and petitioner has no criminal antecedent and has remained in custody for three months.

Having heard both sides and considering the fact that huge quantity of cough syrup containing codeine has been recovered from the petitioner, I am not inclined to grant bail to the petitioner. However, he may renew his prayer for bail after framing of charge in this case.

With the aforesaid observations, this application is dismissed.
