The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302/ 201/ 34 of the Indian Penal Code.

As per prosecution, against the petitioner that when the informant came to know that dead body of his daughter is hanging on the Banyan tree because of land dispute was going between the informant and his brother Jagdish Mukhiya due to which family members of Jagdish Mukhiya has committed murder of her daughter by pressing her neck.

Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence and has been falsely implicated in the present case only on the basis of

During investigation, witnesses had stated that the victim had stolen the mobile of accused petitioner and the victim was caught red handed by the accused petitioner while she was talking with some other person and on scolding her with stranger, due to fear she hanged herself. Petitioner is languishing in judicial custody since 21.07.2022.

Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chhatapur P.S. Case No. 54 of 2022, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Supaul.
