The petitioner seeks bail in Kahalgaon (Ghogha) P.S. Case No. 262 of 2016, registered for the offences punishable under Sections 25(1-b)A, 26, 35 of the Arms Act. The petitioner and two other accused persons were apprehended by the police and from possession of the petitioner one loaded country made pistol is said to have been recovered. Learned counsel for the petitioner submits that similarly situated co-accused Vikash Kumar @ Vikky @ Vikka from whose possession one country made pistol was also recovered has already been granted bail vide order dated 23.01.2017 passed in Cr. Misc. No. 2107 of 2017. The petitioner has already remained in jail for more than seven months and he has got only one case i.e. Sabour

Patna High Court Cr.Misc. No.11635 of 2017 (2) dt.17-03-2017 2/2 P.S. Case No. 120 of 2016 pending against him. Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Kahalgaon (Ghogha) P.S.
